In this case, the defense’s main argument was that “plaintiff was basically a liar.” The defense hired private investigators to follow the plaintiff around and surreptitiously film his daily activities. The jury concluded plaintiff’s pre-existing, soft tissue neck and back injuries were aggravated in the accident and awarded plaintiff over $600,000. “$75,000 for past pain and suffering; $175,000 for future pain and suffering; $20,000 for past mental pain and suffering; $107,000 for past medical expenses; $60,000 for future medical expenses; and $150,000 for loss of enjoyment of life…and $25,000 for loss of consortium.”
