Bicycle accident claims do not get judged the way car accident claims do. Insurance adjusters ask what you were wearing, whether you signaled, and how far you were riding from the curb, because shifting blame onto the cyclist is cheaper than paying for what the driver did. You need your claim judged on the driver’s actions, not on excuses about your bike.
The team at Gauthier Amedee Injury Lawyers, your Galvez personal injury lawyers for cases just like this, treats every claim the same way: build the case around what the driver owed you on the road, not what you were wearing. That approach already stands behind a $5 million jury verdict, and it is exactly what our attorneys bring to your case next. Prior results do not guarantee a similar outcome.
Contact Galvez bicycle accident lawyers and tell us how the crash happened. We can explain what your wrecked bicycle, your medical bills, and your recovery may be worth before you say another word to an adjuster.

Louisiana law treats you, as a cyclist, the same as any driver on the road. Under La. R.S. 32:194, you have the same rights and the same duties as the driver of a car. That cuts both ways. If you followed the rules of the road, the driver who hit you cannot use your choice to ride a bicycle as a defense. But insurers know that many roads through rural Ascension Parish carry no marked bike lane and no paved shoulder, and they will look for any reason to argue you rode too far from the curb or too close to traffic.
Bicycle injuries in car-versus-bike crashes also tend to be severe, since a rider has no metal frame for protection. That’s exactly why insurers move fast to minimize what they pay before you know the full extent of your injuries.
Louisiana changed this law on January 1, 2026, and the new rule is much less forgiving than the old one.
Under the current version of La. Civ. Code art. 2323, if a jury finds you 51% or more at fault for the crash, you recover nothing at all, no matter how badly you were hurt or how careless the driver was. If your fault is 50% or less, your compensation is simply reduced by that percentage.
Before this change, Louisiana let you recover something no matter your share of fault. Now, one percentage point can be the difference between a real recovery and walking away with zero. This is exactly why insurers push so hard to argue that a cyclist caused their own crash: getting you to 51% ends the claim entirely.
We build your case to show the driver’s actions clearly, using the police report, any traffic camera footage, and witness accounts, so fault lands where it actually belongs instead of wherever the insurance company wants to put it.
These results, drawn directly from cases Gauthier Amedee Injury Lawyers has taken to verdict or settlement in Louisiana, show the range of outcomes possible when a driver’s negligence causes serious injury. Every crash is different, and a result in one case does not predict a result in another.
| Outcome | Case Type |
| $5 Million | Auto Accident Jury Award |
| $1.5 Million | Personal Injury Jury Award |

Not necessarily. Louisiana law gives you the same right to the road as any driver, and many rural roads near Galvez do not have a marked bike lane. An insurer’s claim about where you were riding does not erase the driver’s duty to see you and yield. We push back on that argument whenever an insurer raises it.
Louisiana gives you two years from the date of the crash to file a bicycle accident claim under La. Civ. Code art. 3493.1. But the deadline can be shorter or longer— for example, if a government vehicle or agency was involved, if you didn’t discover your injury right away, or if the injured person is under 18. This two-year rule applies to crashes on or after July 1, 2024.
You are not required to hire a lawyer, but insurers respond differently when you have an attorney instead of handling the claim on your own. We handle the adjuster calls so you can focus on healing.
We work on contingency, so you pay nothing upfront and owe us nothing unless we recover money for you. Your first consultation is free.
It changes what evidence matters most. On roads without a marked shoulder or bike lane, we focus on the driver’s speed, sightlines, and following distance instead of lane position. That is often the difference between a denied claim and a paid one.
Louisiana requires drivers to carry liability insurance, but not every driver does. If the at-fault driver was uninsured or underinsured, we look at your own policy’s uninsured motorist coverage and any other liable party to recover what you may be owed.
You do not have to prove your case to an insurance adjuster by yourself, and you do not have to accept blame for wearing dark clothes or riding without a bike lane. Contact Gauthier Amedee Injury Lawyers and tell us what the driver did. Whether the crash happened on a quiet Galvez side street or a stretch of rural highway with no shoulder, we start by getting the facts on your side. We work on contingency, so there is no fee unless we win, and no cost to find out what your bicycle accident claim is actually worth.
